Workers in Florida will see an increase in pay as the state’s minimum wage rises to $15 an hour on Sept. 30, 2026.
Florida Commerce announced the new minimum wage, which will remain in effect until the next scheduled adjustment. Beginning in 2027, Florida’s minimum wage will be adjusted annually for inflation, with the new rate taking effect each Jan. 1.
Employers must pay employees the new minimum wage for all hours worked in the state under the federal Fair Labor Standards Act. For tipped employees, employers must pay a direct wage of at least $11.98 per hour, while up to $3.02 per hour in tips can be counted toward the $15 minimum wage.
Section 448.109 of the Florida Statutes requires employers to post a minimum wage notice in a location accessible to employees. Employees who believe they are not being paid the required minimum wage may pursue a civil action against their employer. Before filing a lawsuit, employees must provide written notice to their employer and allow 15 days for the issue to be resolved.
The minimum wage increase began Nov. 3, 2020, when Florida voters approved a gradual increase each year until reaching $15. Florida’s minimum wage was $8.56 in 2020, meaning it has increased by $6.44 over the past six years.
